KillerGrowth ("Company", "we", "us", or "our") provides digital marketing and consulting services to the purchasing individual or entity ("Client") as described within the selected service package. Specific deliverables are defined by the package selected at checkout or within an executed service agreement.
This package includes development of a new website, platform and tool selection at KillerGrowth’s sole discretion, ongoing content edits and minor updates, and general maintenance and optimization. KillerGrowth retains full discretion to select hosting platforms, CMS systems, themes, plugins, and other tools used to build and maintain the website. Platforms and tools may change during the term if deemed necessary for performance, security, or strategic reasons. Major redesigns, additional functionality, or new builds outside the original scope may incur additional fees.
This package includes one-to-three posts per week (based on package subscribed to), bi-yearly video/photo shoots, comment engagement, and message monitoring. Client must provide timely access to accounts and necessary brand assets. Additional content creation beyond scope may require additional fees.
This package includes ad design (photo/video assets provided by Client), creative strategy, campaign build, targeting, A/B testing creative, attribution tracking, and monthly reporting. Advertising spend is not included in management fees and is paid directly by Client to the advertising platform.
This package includes creative strategy, campaign building, weekly optimization, keyword tracking, negative keyword optimization, and monthly reporting. Advertising spend is not included in management fees and is paid directly by Client to Google.
This package includes Google Business Profile (GBP) management five (5) days per week, one-time GBP optimization, GBP Q&A content creation and posting, GBP photo uploads, GBP post creation and posting, heatmaps, directory listings, Google Map citations, Advanced GStack, Cloud Stack, GEO rankings, four (4) blogs per month, one (1) YouTube stack per blog, one (1) podcast stack per blog, image stacks, and monthly reporting. SEO results are not guaranteed due to algorithm changes and external ranking factors.
Consulting includes one (1) 45-minute Zoom session per month. Pricing is $250 per session for one-on-one consulting or $500 per session with the KillerGrowth leadership team. Unused sessions do not roll over.
All fixed-term agreements automatically continue on a month-to-month basis following the initial term unless canceled in writing. A minimum of thirty (30) days’ written notice is required for cancellation after the initial agreement term. Early termination prior to completion of the agreed term may require payment of remaining contracted fees.
Payment is due in advance on a recurring monthly basis. Setup fees (if applicable) are billed on the first invoice. Late payments may result in service suspension. All payments are non-refundable unless otherwise agreed in writing.
Client agrees to provide necessary access to accounts, platforms, and assets; provide timely feedback and approvals; maintain active advertising accounts when applicable; and ensure compliance with industry regulations applicable to their business. Delays in communication or access may impact performance and timelines.
Upon full payment, Client owns final website content and approved creative assets. KillerGrowth retains ownership of proprietary systems, workflows, templates, strategies, and internal methodologies. KillerGrowth may showcase non-confidential work in its portfolio unless otherwise agreed in writing.
Marketing performance is influenced by numerous external factors beyond KillerGrowth’s control, including market conditions, competition, platform algorithm changes, client response speed, and advertising budgets. KillerGrowth does not guarantee specific revenue, ranking positions, lead volume, or return on investment outcomes.
Both parties agree to keep confidential information private and not disclose proprietary information to third parties without written consent.
KillerGrowth shall not be liable for indirect or consequential damages, lost profits, platform account suspensions, or third-party service outages.
KillerGrowth shall not be liable for delays or failure to perform due to causes beyond reasonable control, including natural disasters, government actions, or platform outages.
KillerGrowth reserves the right to modify these Terms of Service. Continued use of services constitutes acceptance of updated terms.
These Terms shall be governed by the laws of the State of Kansas, without regard to conflict of law principles.
These Terms, along with any executed proposal or order form, constitute the entire agreement between the parties.
